The authorities below have levied stamp duty by treating the affidavit
annexure-1, wherein the petitioner has deposed that the house in dispute has
devolved upon him and as is liable to be recorded in his name, as a transfer
deed.
Learned Standing counsel prays for and is allowed six weeks’ time to file
counter affidavit. Two weeks’ thereafter are allowed to the petitioner for filing
rejoinder affidavit.
List thereafter.
Until further orders of this Court, the operation of the impugned order dated
12.05.2010 and the appellate order dated 12.07.2010 shall remain stayed.
