Affidavit on behalf of respondent No.1 filed in Court is

taken on record.

The petitioner is a Post Graduate having M.Sc. in

Computer Science from University of Bikaner. Being Post Graduate,

the petitioner appeared in the Joint B.Ed. entrance test for the

session 2006-2007 for admission in Colleges of Education in UT

Chandigarh and State of Punjab affiliated to Panjab, Punjabi and

Guru Nanak Dev Universities. The eligibility criteria for admission is

either Bachelor’s Degree of Panjab University or any other University

with at least 50% marks in the aggregate or M.A. or M.Sc. (Hons.

School) or M.Com. Degree of the University or any other recognized

University with a minimum of 50% marks in the aggregate with

combination of at least two school level subjects at Graduate/Post

Graduate Degree level.

The petitioner sought admission in the course having

obtained 61.95% aggregate marks in M.Sc. (Computer Science) from

the University of Bikaner and thus having satisfied the second

eligibility criteria. The petitioner was admitted in respondent No.2-

College. The petitioner was issued Roll Number for appearing in the

final examination in May 2007 but in July 2007 he was informed that

he was not eligible for admission as the Degree of M.Sc. (Computer

Science) obtained by him from the University of Bikaner is neither

recognized nor equivalent to M. Sc. (Information Technology)

examination of Panjab University. Aggrieved against the rejection of

his candidature for examination of B.Ed., the petitioner has invoked

the writ jurisdiction of this Court.

Mr.Sibal has pointed out that for M.Sc. (Information

Technology) examination of Panjab University, a candidate is

required to have bachelor’s degree in Computer Science. Therefore,

M.Sc. degree of the petitioner has not been declared equivalent by

the Panjab University.

Though the counsel for the petitioner has referred to

various judgments to contend that having permitted to undergo the

complete academic year and also to appear in the final examination,

the University is estopped to dis-qualify the petitioner for admission

and appearing in the examination. But we are of the opinion that

without examining the said aspect any further, it would be appropriate

to direct the University to re-consider the question of equivalence of

M.Sc. degree in Computer Science of University of Bikaner with the

degree of M.Sc. (Information Technology) examination of Panjab

University. This is necessitated in view of the fact that the Computer

Science is a developing subject, which is open to candidate from

different disciplines. Restrictive scope of admission in M.Sc.

(Information Technology) examination of Panjab University may not

be a good yardstick for determining of equivalence of Computer

Science degree obtained by the petitioner from University of Bikaner

with that of Information Technology examination of Panjab University

and in view the fact that the petitioner has sought admission in B.Ed.

Course, which is independent and not dependent upon the Computer

Science.
