                                 ORDER

The short prayer in this petition is for

extension of time for payment of Rs.50,000/-

granted by the court below.

2. Petitioner was the accused in C.C.533

of 2005 before the Judicial Magistrate of the First

Class-II, Pala for having committed offence

punishable under Section 138 of the Negotiable

Instruments Act. She sought the benefit of plea

bargain and suffered an order, by which she was

directed to pay a sum of Rs.50,000/- as

compensation within a period of six months,

failing which she had to undergo simple

imprisonment for two months.

3. Petitioner says that she could not

raise the amount since her husband suddenly fell

ill and she had to spend the amounts for the

treatment. She is making earnest efforts to raise

funds by selling an item of property, which she could

not do so far. Therefore she prayed that some more

time may be granted.

4. There seems to some justification in

seeking extension of time. Petitioner only wants to

make earnest efforts to sell the property and raise

funds to pay the amount.

Considering all the circumstances, this petition is

allowed and the petitioner is granted two months

time from today to pay the amount as ordered by

the court below in C.C.533 of 2005.
