Background
1. The Applicant filed an RTI application dt.12.8.08 with the CPIO, DoP, New
Delhi. He requested for the photocopies of the evaluated answer sheets of
Paper IV of PSS Gr.B exam held on 16.7.08. The CPIO replied on 18.9.08
stating that photocopies of answer sheets of other candidates cannot be
supplied. However, photocopies of applicant’s answer sheet of Paper IV can
be supplied on depositing Rs.42/-. The Applicant filed an appeal dt.29.9.08
with the Appellate Authority. The Appellate Authority replied on 14.10.08
upholding the decision of the CPIO. The Applicant then preferred an appeal
before the before CIC on 16.3.09.
2. The Bench of Mrs. Annapurna Dixit, Information Commissioner, scheduled the
hearing for May 6, 2009.
3. Mr. Satish Kumar, Asstt. UDC and Mr. Lokesh Gupta, UDC represented the
Public Authority.
4. The Applicant was not present during the hearing.
Decision
5. The Respondent submitted that the Applicant had failed by 10 marks and he
wants the answer sheets of the other candidates to compare his marks with
theirs. The Commission denies disclosure of answer sheets of other
candidates other than that of the Applicant himself under section 8(i)(j) of the
RTI act since it holds that the disclosure would cause unwarranted invasion of
the privacy of the other individuals concerned.
6. The appeal is disposed off.
