Yadav, learned counsel for the complainant and learned AGA for the State.
Learned AGA files an affidavit of Sri Maneshan Babu, the I.O. of this case. It
is a case in which Pramod and Ravish have kidnapped the girl namely Manju
aged about 15 years. This Court has passed several orders to recover the
alleged kidnapped girl for which S.P. Firozabad and I.O. have been
summoned. This Court has passed orders repeatedly on taking the assurance
from the side of S.P. and I.O of this case that they shall recover the alleged
kidnapped girl but it is unfortunate that they have not recovered the alleged
kidnapped girl. Even after giving the oral evidence to this Court and he had
assured that the kidnapped girl shall be recovered, the applicant Ravish and
co-accused are in jail since 26.6.2008. This Court has no option except to
release the applicant on short term bail for a period of six months.
In the meantime, the I.O. of this case and S.P. Firozabad shall make their
positive efforts to recover the alleged kidnapped girl. His progress report shall
be submitted to this Court on or before 8th March, 2010 in case the efforts are
not made positively the proper action shall be taken against the S.P. Firozabad
and I.O. of this case.
List on 8th March, 2010 at that date S.P. Firozabad and I.O. of this case shall
appear in person.
Let the applicant Ravish involved in case crime no. 120 of 2008, under
Section 363, 366 and 368 I.P.C. P.S. Eka, District-Firozabad, be released on
short term bail for a period of six months on his furnishing a personal bond
and two sureties each in the like amount to the satisfaction of the Court
concerned.
Let a copy of this order may be communicated to learned AGA for the
compliance.
