The Appellant was not present in spite of notice.
On behalf of the Respondent, Shri Dhirendra, APIO was present.
2. This case was posted for hearing today through videoconferencing. The
Appellant was not present in spite of notice. However, the Respondent was present
in the Bangalore studio of the NIC. He brought to our notice the fact that this very
appeal had been heard by us earlier on 27 November 2009 in the appeal number
CIC/SM/A/2009/000196 and that we had given certain directions to the CPIO. He
further submitted that the CPIO had since implemented our order under intimation
to the CIC.
3. We compared the content of the present case with the above appeal and
found both to be the same. It appears the CIC Registry had received copies of the
same appeal at different times and had, therefore, registered two separate cases.
There is no need to pass any fresh order in this case. It is, thus, disposed off.
4. Copies of this order be given free of cost to the parties.
