Each one of the respondents is granted six weeks’ time to file counter
affidavit. Rejoinder affidavit may be filed within next two weeks.
List thereafter.
It has been contended on behalf of the petitioner that in the present case while
undertaking formal inquiry, neither charge sheet, whatsoever, had been given
to the petitioner nor had the Inquiry Officer fixed any date, time or place of
inquiry. Petitioner submits that the inquiry report has been arbitrarily
submitted without providing any opportunity of hearing.
Prima facie, the argument advanced on behalf of the petitioner appears to
have some substance and same requires consideration by this Court, as such
till the next date of listing operation of the impugned order dated 10.12.2009
passed by District Magistrate, Jaunpur, in so for as it directs recover y of the
amount from the petitioner, shall be kept in abeyance.
