Notices on behalf of respondent nos. 1 to 4 have been accepted by the learned
standing counsel and on behalf of the other respondents by Shri Manish
Jaiswal, Advocate.
They pray for and are granted three weeks’ time to file counter affidavit. Two
weeks’ thereafter for rejoinder affidavit.
The facts of the case are not much in dispute. There is a registered sale deed
by the recorded tenure holder in favour of the petitioner. The contesting
respondents claimed that there is a registered agreement of sale in their favour
along with delivery of possession, therefore, the said transaction is “sale”
within the meaning of the U.P.Z.A & L.R Act. The name of the petitioner
cannot be mutated.
The matter requires consideration.
In this view of the matter, the parties are directed to maintain status quo as
regards the nature and possession of the property in question till further
orders.
