ORDER
Mr.R.H.Joshi,
describing himself as Principal, Shree Bhakti Vidhyalaya at ‘Vadia’,
Tal.: ‘Savli’, Dsit.: Vadodara along with Mr.I.M.Mistry, describing
himself as Secretary of the Trust are present before the Court.
Mr.R.H.Joshi
seems to be ignorant and does not understand the gravity of the
matter.
2. In this
matter, on 18.06.2010, this Court (Coram: Hon’ble Mr.Justice
K.S.Jhaveri) issued notice making it returnable on 09.07.2010, so far
as Principal, Shree Bhakti Uttar Vidhyalaya is concerned.
2.1 Mr.Joshi
states before the Court that on 09.07.2010, he had remained present
before this Court and on that day, while he was present in the Court,
the matter was adjourned to 23.07.2010 and taking note of this, he
went away and did not remain present on 23.07.2010 or thereafter.
3. On
17.09.2010, this Court passed the following order:-

Learned AGP Ms. Manisha Narsinghani, instructed by Shri MK Khant,
Assistant Education Inspector from the office of the District
Education Officer, Vadodara states that despite number of letters
written to the institution, the institution has not responded to
them. The learned AGP wants time to place on record the action
taken against institution, which may be taken, if not already taken.

3.1 On the next
date of hearing, i.e. 20.09.2010, learned AGP stated that:-

Notice issued to the school on 18th September 2010 asking
the school to submit its explanation within 7 days for not complying
with the directions issued by the District Education
Officer…………
3.2 On
30.09.2010, learned AGP stated that:-
though the
attempt was made to seek cooperation from respondent no.4
Principal, Shri Bhakti Vidhalaya at Vadia, Taluka Savli, District
Vadodara, she is not able to procure the same…….
3.3 This Court
therefore issued direction to respondent No.4 Principal, Shree
Bhakti Vidhyalaya to remain personally present before this Court
today, i.e. 07.10.2010.
4. Mr.R.H.Joshi
and Mr.I.M.Mistry tender apology to this Court and assure that they
will see to it that necessary record of the Trust is obtained from
the past President of the Trust, who has expired in the year 2004 and
the same will be produced before the District Education Officer at
the earliest. They pray for a week’s time.
5. To give them
an opportunity to extend full cooperation, the matter is kept on
18.10.2010.
It is expected
that by that time, not only they will procure the record from the
past President but will also produce the same before the District
Education Officer.
