1. The RTI application was filed on 9.5.2008. The Appellant requested
for information regarding computers and other related hardware
given to the CGHS Dispensary, Janakpuri by the Ministry of Health &
Family Welfare. The information was requested against 13 points.
The CPIO vide letter dated 23.5.08 transferred the copy of the
Appellant’s RTI request to the CGHS Hqrs. in New Delhi for
information. The CGHS Hqrs. in turn passed on the request to the
CPIO, CGHS Dispensary, Janakpuri, New Delhi. The first and second
appeals were filed together by the Appellant on 11.7.08 on not
receiving any response. He reiterated his request for the information
and demanded imposition of penalty on the CPIO under Section 20 of
RTI Act for not giving him any information.
2. The Bench of Mrs. Annapurna Dixit, Information Commissioner, heard
the matter on October 24, 2008.
3. The Appellant was present at the hearing.
4. Mr. Dr. Nath Singh Rawat, CMO, CGHS and Mr. Sanjay Kumar, LDC,
represented the Public Authority
Decision
5. The CPIO was not present. The Respondents submitted that they
were not dealing with the case but have attended the hearing since
the CPIO was busy in a meeting. The Respondents informed the
Commission that most of the information regarding computers is only
available with NIC and the remaining with the Ministry.
6. Since searching through the files would put pressure on the Public
Authority and also result in disproportionate diversion of resources,
the Commission directs the CPIO, M/o Health & F.W. to facilitate the
Appellant inspect the relevant files in NIC for the information he
wants and provide certified copies of required documents.
7. As for information available with the Ministry, the Commission directs
the CPIO, M/o Health & F.W. to provide the same to the Appellant
within 15 days of receipt of this Order.
8. The appeal is disposed off.
