Heard Sri B.R. Singh, learned counsel for the petitioner and
learned Standing counsel for the opposite parties.
This is third writ petition filed by the petitioner. Argument of the
petitioner counsel is that twice he approached the Court and twice
this Court has directed that inquiry should be completed in a
stipulated period. The argument raised by learned Standing
counsel on earlier occasion what that the petitioner is not
cooperating with the inquiry. This Court while passing the order
in the first writ petition had specifically observed that in case
petitioner is not cooperating with the inquiry, the opposite parties
will be at liberty to pass ex-parte orders which is even allowed in
the rules. The opposite parties by not taking a decision and by not
completing inquiry in time are not only guilty of arbitrary action
but their action also touches the verge of contempt.
Learned Standing counsel prays for and is granted a week’s time to
seek instructions as to why and under what circumstances the
orders of this Court are being flouted and the inquiry is not being
completed.
