By means of this writ petition order dated 5.5.2006 passed by the Special
Secretary U.P. Shasan, Excise Anubhag 2, Lucknow has been challenged.

The aforesaid order has been assailed in view of the liberty so given by this
Court while deciding the writ petition no. 1260 of 2006 vide judgment and
order dated 29.7.2009.

Issue notice to the sole respondent returnable at an early date who shall be
free to take objections with regard to latches in filing the writ petition.
