Heard learned counsel for the applicant and learned A.G.A.
It is contended by learned counsel for the applicant that the notice was
served upon the applicant on 7.11.2008, but the complaint has been filed on
17.12.2008 which is beyond the time. It is further contended that the cheque
in dispute was given in security because there was business relation relation-
ship between the applicant and O.P.No.2, the same has been misused by
O.P.No.2.
Issue notice to O.P. No. 2 returnable within four weeks.
In view of the submissions made by the learned counsel for the applicant and
the learned A.G.A. further proceedings of Complaint Case No. 2026 of 2008
under section 138 N.I.Act, P.S. Garhmukteshwar, District Ghaziabad
pending in the court of Additional Chief Judicial Magistrate, Hapur,
Ghaziabad shall remain stayed till the next date of listing.
List after four weeks for orders.
