Civil Application:
Rule.
Mr. A.V. Prajapati, learned advocate for opponent No. 1 & 4,
waives service of rule. Operation and implementation of the judgement
and order dated 21.6.2006 passed by Motor Accident Claims Tribunal,
Mehsana, in M.A.C. P. No. 217 of 2005 shall remain stayed provided
that the applicant deposits the award money before the Tribunal. Half
of the money will be available to be disbursed to the claimants
against solvent security within a period of eight weeks from today
and the remaining amount will be deposited in a Scheduled Bank in
cumulative Fixed Deposit for recurring period until disposal of the
appeal.
With
the aforesaid observations and directions, the Civil Application is
disposed of. Rule is made absolute to the aforesaid extent.
