Heard learned counsel for the appellant and the

counsel appearing on behalf of the State.

I.A. No. 1815 of 2011 is a petition through which

the appellant has prayed for bail on the ground of his detention

since 11.12.2005.

No doubt the prayer for bail of the appellant was

rejected earlier, but considering his period of detention the

appellant is directed to be released on bail, during the

pendency of this appeal, in S. T. No. 398 of 2008 on

furnishing bail bond of rupees ten thousand with two sureties

of the like amount each to the satisfaction of the Additional

Sessions Judge, Saran at Chapra and the realization of fine is

stayed.
