                     No.CIC/PB/C/2008/0447-SM dated 03.10.2007
Right to Information Act-2005-Under Section (19)

                                                                  Dated 28.05.2009
Complainant : Mrs. Shakuntala

Respondent : Punjab National Bank

On behalf of the Complainant the following are present:-

       (i) Shri Satya Paul
       (ii) Shri J.N. Guleria

On behalf of the Respondent, the following are present:-

(i) Shri S.P. Mamgain, Senior Manager (Law)

(ii) Shri S.K. Jain, Chief Manager

(iii) Shri S. Singh, Sr. Manager

The brief facts of the case are as under.

2. The Complainant had sent an application to the SIC, Dehradun seeking a
number of information in respect of the Fixed Deposit Receipts (FDR) of Teja Singh,
her father. The CPIO received this application on transfer on 23 October 2007 and
replied to the Complainant on 17 November 2007 explaining that the information
sought was regarding the FDR details of a third party and, therefore, could not be
disclosed to her. Besides, he also informed her that the Branch, after a thorough
search, could not locate any such account in the name of Teja Singh in that Branch.
The Complainant approached the SIC against the denial of information by the CPIO.
The SIC advised the Complainant to approach the CIC in the matter as the Public
Authority came under the latter’s jurisdiction. That is how this complaint has now
come before us.

3. During the hearing, both the sides were present and made their submissions.
We carefully examined the original application of the Complainant addressed to the
SIC which formed the basis of this case. The Complainant had not given any details
about the said FDR, such as, its number or the likely date of its issue by the Bank.
Even if it is presumed that the Bank should provide this information to the
Complainant as the legal heir of the person in whose favour these FDRs had been

issued, in the absence of sufficient details, as submitted by the Respondent, it would
be difficult for the Bank to find out about these FDRs. In any case, the Respondent
submitted that the Branch concerned had indeed searched its records to find out if
any account in the name of Teja Singh existed but did not find any. The Complainant
stated that there was no other detail about these FDRs available with them. In these
circumstances, we are afraid, there is nothing more to be done in this case and,
hence, we dispose of this complaint without any further orders or direction.

4. Copies of this order be given free of cost to the parties.
