3. 12.07.2010. Heard learned counsel for the

petitioner and counsel appearing for the

State.

The petitioner being the husband is

apprehending his arrest in connection with a

complaint case in which cognizance has been

taken under Section 498A of the I.P.C. and

Section 4 of the D. P. Act.

It is submitted by the learned counsel

for the petitioner that the petitioner is

ready to keep the complainant as wife with

full dignity and honour.

In that view of the matter, let the

petitioner, Md. Taiyab, be released on

provisional anticipatory bail for six months

on his surrender before the learned court

below within a period of twelve weeks from

today in connection with complaint case no.

272C of 2009 on furnishing bail bond of Rs.

10,000/-(Ten Thousand) with two sureties of

the like amount each to the satisfaction of

the learned S.D.J.M., Saharsa, subject to the

conditions as laid down under Section 438(2)

of the Cr.P.C.

Let the S.D.J.M., Saharsa, issue notice

to the complainant and fix a specific date

within a month on which date the petitioner

and the complainant will appear before the

learned court below and from the court itself

the petitioner will take the complainant to

the matrimonial house.

If the learned court below finds within

five months that the matrimonial ties has

been restored then the learned court below

will confirm the provisional bail of the

petitioner or if the complainant refuses to

go or stay with the petitioner then in that

condition also the provisional bail will be

confirmed otherwise the petitioner will seek

for regular bail.
