At the outset, learned counsel for the petitioner submits that he does not want
to press the application for amendment.
Accordingly, application is rejected as not pressed.
Heard learned counsel for the petitioner and learned Standing Counsel.
Learned Standing Counsel submits that by means of the instant writ petition,
the petitioner prays for a direction to the opposite party No.3 to decide the
representation/appeal of the petitioner dated 8.1.2008 on the basis of the query
dated 12.3.2008, expeditiously, for promotion to the post of Naib Tehsildar
with effect from the date his junior namely Sri Siddh Nath Awasthi was
promoted to the said post and during the pendency of the instant writ petition,
the appeal/representation of the petitioner dated 8.1.2008 has been decided by
the State Government and as such, the writ petition has rendered infructuous,
to which learned counsel for the petitioner has no objection.
Accordingly, the writ petition is dismissed as infructuous.
However, it is provided that since the petitioner is going to retire on
31.1.2010, as such, opposite parties are directed to pay the outstanding dues,
if any, to the petitioner.
