This revision is directed against the order dated 11.05.2011
passed by learned District & Sessions Judge, Godda in Cr. Appeal
No.39 of 2011, whereby he rejected the appeal of petitioner and
consequently refused to enlarge him on bail.

It is submitted that petitioner is juvenile, therefore, he is entitled
to be released on bail as per Section 12 of The Juvenile Justice (Care
and Protection of Children) Act. It is further submitted that others co-
accused, who are also juvenile have been granted bail vide Annexures 3
and 4. The case of petitioner is similar to aforesaid co-accused.

Learned Additional P.P., after going through Annexures 3 and 4,
has not disputed aforesaid submission.

Considering the aforesaid facts and circumstances, especially
taking into account that others co-accused, who are also juvenile have
been granted bail vide Annexures 3 and 4, I allow this revision
application and set aside impugned orders of the courts below. I further
direct that petitioner, Jahid Ansari be enlarged on bail on furnishing bail
bond of Rs.10,000/- (ten thousand) with two sureties of the like amount
each to the satisfaction of learned Juvenile Justice Board, Godda in
connection with Boarijore (Lalmatiya) P.S. Case No.93 of 2010
corresponding to G.R. No.1085 of 2010 (Enquiry No.175 of 2011).
