The petitioner has retired as a Class – III employee from the
institution on 31.8.2007. Though he has been paid G.P.F. amount
on 29.10.2009, his pension and gratuity has not been released.
Learned Standing Counsel, who has accepted notice on behalf of
respondents no.1 to 3 submits that the matter can be examined by
the District Inspector of Schools, respondent No.3.
In view of the submissions made, without expressing any opinion
on the merits of the claim of the petitioner, the writ petition is
finally disposed of with the consent of the parties with liberty to
the petitioner to make a comprehensive representation ventilating
his grievance before respondent no.3, District Inspector of Schools
along with the certified copy of this order within two weeks from
today.Needless to say that in case such a representation is made
within the time stipulated, the respondent no.3 shall consider and
decide the same by a speaking order in accordance with law,
without being influenced by any observation made herein above,
as expeditiously as possible, preferably within two months from
the date of submission of the representation and the payment shall
be made as per the order so passed.
Petition disposed of as above.
