                         J U D G M E N T

The prayer sought in this writ petition is to quash Ext.P7,

returning the financial bid submitted by the petitioner for the

work of Improvement of Riding quality in KM 87/000 to 99/000 on

NH 213 by providing 50 mm BM and 30 mm BC in the State of

Kerala. The further prayer sought is to direct the respondent to

consider the financial bid submitted by the petitioner for the

aforesaid work.

2. Since the petitioner’s bid has been rejected at the

prequalification stage and as the same has been upheld by this

Court in the judgment in WP(C) No.6912/09 and the review sought

by RP No.320/09 also has been dismissed today, there is no

question of directing the respondent to consider the financial bid

submitted by the petitioner.

Writ petition is only to be dismissed and I do so.
