3. 05. 07. 2010. Heard learned counsel for the petitioner and the State.

The petitioner being a lady Mukhiya of Gram Panchayat

is apprehending her arrest registered for offences under Sections

406, 409, 467, 468, 471 and 120 B of the Indian Penal Code.

It is alleged that petitioner demanded Rs. 5,000/- for the

purpose of sanction of house under Indira Aawas Scheme. It is

further alleged that Rs. 24,000/- of the informant’s son was

withdrawn by placing some one on identification of one Indradeo

Sada and Jai Narayan Yadav.

It is submitted by the learned counsel for the petitioner

that allegation of withdrawing the amount is not against the

petitioner. Moreover, informant’s son has got the entire amount and

has already constructed the house, petition to this effect has been

filed vide Annexure 2 and 3.

Considering the fact that the informant and his son

retracted from initial averment and the petitioner being a lady, in

the event of her arrest/surrender in the court below within a period

of four weeks from today, the above named petitioner shall be

released on bail on furnishing bail bond of Rs. 10,000/- (Ten

thousand) with two sureties of the like amount each to the

satisfaction of the Chief Judicial Magistrate, Saharsa, in connection

with Sour Bazar P.S. Case No. 163/08, subject to the conditions as

laid down under Section 438 (2) of Cr.P.C.
