Heard learned counsel for the applicant and learned A.G.A. for the State.
The accused-applicant Rajjan Lodh is involved and detained in Case Crime
No. 1290 of 2009, under Sections 304, 352, 323, 504, 506 I.P.C. and 3 (2) (5)
SC/ST Act, from Police Station Achalganj, District Unnao.
The submission of learned counsel for the applicant is that co-accused Ravi
and Rajjan Lodh (present applicant) are said to have given lathi blows to the
complainant Kedar. As per medical examination report of Kedar, no visible
injury was found on his body; rather he complained pain in his body. Co-
accused Ravi has already been ordered to be released on bail vide order dated
05.11.2009 passed by this Court in Crl Misc Case No. 7447 (B) of 2009.
Nothing has been alleged by the complainant that the present accused
applicant had given lathi blow to the deceased Puran Das. Therefore, the
present accused applicant deserves to be released on bail.
Learned A.G.A opposed the bail application.
Considered the submissions of the learned counsel for the applicant and the
learned Additional Government Advocate. Keeping in view the role assigned
to the accused applicant in the alleged occurrence as well as facts of the case,
without expressing any opinion on the merits of the case, applicant may be
released on bail.
Let applicant Rajjan Lodh be released on bail in aforesaid case crime number
on his furnishing a personal bond with two sureties each in the like amount to
the satisfaction of the court concerned.
