We have already decided the issue raised in this appeal by our

judgment rendered on 5th February, 2008 in W.A.No.150 of 2008 and

connected cases. The facts in this case are similar to the facts in the said

cases. We do not find any reason to take a different view in this matter.

Accordingly, following the said decision, this writ appeal is also

dismissed.
