12.10.2010, learned counsel for the

petitioner had sought for permission to

withdraw this application as the trial

of the petitioner had already ended in

acquittal. Accordingly, the case was

permitted to be withdrawn. However, by

mistake of the office, another order

has been recorded as passed on that

date calling for a report.

                         Order      no.2,        as         passed        on

                  12.10.2010     calling    for        a    report       is,

                  therefore,     recalled     and       the    case       is

dismissed as withdrawn.
