The contention of the learned counsel for the petitioner is that the order
against which the revision has been filed before the Additional Commissioner
(Admn.), Gorakhpur Division, Gorakhpur is an interlocutory order and as
such the revision is not maintainable. By the said order, the Sub Divisional
Magistrate has only ordered the issuance of the notice.
The said argument of the learned counsel for the petitioner has got some
substance. However, it is not necessary to decide the said controversy as the
respondents are not represented.
The writ petition is disposed of by providing that Revision No.100/102/M-
2010 (Vijayi Prasad versus Srikrishna & others ) pending before the
Additional Commissioner(Admn.) , Gorakhpur Division, Gorakhpur be heard
and disposed of preferably within a period of four months from the date of
production of certified copy of this order.
The parties are directed to maintain status quo till the disposal of the revision.
