the facts and circumstances of the case, the order passed in SCA
No.963 of 1997 at Annexure – A to the present application is
recalled and the main matter being SCA No.963 of 1997 to be listed
for hearing on 25/11/2010. It will be open for the applicant to
raise the contentions of the present MCA at the time of hearing of
SCA.

Rule
is made absolute to the aforesaid extent. Accordingly, the present
application is disposed of.
