2. 16.12.2010 Heard the parties.

The petitioner seeks quashing of the

order dated 23.1.2010 by which the Judicial

Magistrate Ist Class, Chapra in Derani P.S. Case

No. 86 of 2007 has taken cognizance to the extent

of Section 376 and 511 I.P.C.

It has been submitted that the

present case is a counter blast to one filed on

behalf of the accused persons and from the fact of

the case no offence under Section 376, 511 I.P.C. is

made out.

Since at the stage of cognizance the

Sections are irrelevant, I am not inclined to

interfere in the matter at this stage. The application

is dismissed.
