Heard Sri Anubhav Chandra, learned counsel for petitioner and Sri Sanjay
Dwivedi, learned counsel appearing for respondents and learned Standing
Counsel.
Petitioner is aggrieved by the order dated 31st December, 2009 by which
petitioner’s appointment on the post of Shiksha Mitra on the basis of some
complaint has been cancelled by competent authority.
The grievance of petitioner is that this order has been passed without any
notice and opportunity to petitioner and no opportunity of hearing was ever
given to petitioner. A specific averment has been made in Paragraphs 17 and
19 to the writ petition.
In view of aforesaid fact, this writ petition is being disposed of finally
directing the respondent No.2 i.e.District Magistrate, Siddharth Nagar to
consider and decide the grievance of petitioner on the basis of relevant record
after affording full opportunity to petitioner and the relevant parties and will
pass a detailed and reasoned order within a period of six weeks from the date
of production of certified copy of this order.
Till the decision taken by the District Magistrate, Siddharth Nagar, the order
dated 31.12.2009 shall be kept in abeyance.
With these observations the writ petition is disposed of.
No order as to costs.
