This
application is filed by the revenue seeking condonation of delay of 5
days in filing the Tax Appeal. We have perused the contents of the
Civil Application and the explanation rendered for the delay. We are
of the opinion that the delay is required to be condoned.

Ordinarily,
we would have issued notice to the other side and hear the respondent
before condoning the delay. In the present case, however, we find
that the delay is of barely 5 days. Issuing notice, therefore, would
cause avoidable inconvenience and possible expenditure to the
respondent.

Under
the circumstances, delay is condoned. Civil Application is disposed
of accordingly.
