Regard being had to the evidence of the victim

and some of the witnesses who reached near her after picking

up the sound of her weeping which supports the allegation that

the appellants had committed rape upon her, I am not inclined

to direct the release of the two appellants, namely, Ram

Bhajan Paswan and Shiv Jatan Paswan on bail at this stgte.

This I.A. is dismissed.

However, if the appeal is not heard and disposed

of in a period of one year from today, the appellants shall be

free to renew their prayer for bail.
