ORAL ORDER

The
present application has been preferred under Section 439 of the Code
of Criminal Procedure for temporary bail in connection with C.R. No.
I-266/2005 registered at Athwa Lines Police Station, Surat for the
offences punishable under Sections 409, 420, 465, 467, 477(A), 471,
384, 385 and 386 r/w 120(B) of the Indian Penal Code.

Having
heard the learned counsel appearing for the applicant and looking to
the facts and circumstances and the order passed by the trial Court,
and the sickness of the applicant which is fever only, I do not see
any reason to entertain this application for grant of temporary bail
to the present applicant.

It
is stated by the learned APP that as per requirement of applicant,
the present applicant can be taken to the hospital for giving proper
treatment. It is also submitted by the learned APP that all possible
treatments shall be given to the present applicant by the Jail
Authorities. She further states that even the Jail Authority is
calling special Doctor for the treatment of the under-trial
prisoners whenever required.

In
view of the above, I do not see any reason to entertain this
application since there is no substance. The Application stands
dismissed.
