Background
1. The RTI request was filed on 14.11.07. The Appellant requested for
information on any action taken on his posting to Group ‘C’ from Group
‘D’, by DOPT. The CPIO replied on 13.12.07 that the Appellant’s
request was being examined and that a letter dated 26.11.07 had
been sent to the Department for seeking clarification on status of
employees whose pay scales have been upgraded. The first appeal
was filed on 15.12.07 wherein the Appellant requested that he should
be considered for Group ‘C’ post since his pay scale was Rs. 2750-Rs.
4400. He stated that the CPIO tried to mislead him by giving him
information he did not seek. The AA, in his Order of 11.01.08, upheld
the decision of the CPIO and stated that the Appellant was appointed
in the pay scale of Rs. 2650-4000 as a Group ‘D’ employee and that
his pay scale was upgraded to Rs. 2750-Rs.4400 wef 16.06.05 in
terms of para 4.3 of Min. of Finance OM no. 19 (i)/IC/86 dated
24/11/1990. The Appellant preferred the second appeal before CIC on
20.08.07 reiterating his request for information as per the RTI
application.
2. The Bench of Mrs. Annapurna Dixit, Information Commissioner, heard
the matter on October 16, 2008.
3. The Appellant was present at the hearing
4. No one represented the Public Authority.
Decision
5. The Commission directs the CPIO to provide information regarding the
Appellant’s promotion to Group ‘C’ from Group ‘D’ with reference to
point 3 in the table given in the Order of the Ministry of Personnel,
Public Grievances and Pensions (DOPT) dated 20.04.1998, within 15
days of receipt of this Order.
6. The case is disposed off .
