02. 06.10.2010 Heard the learned counsel for the petitioner

and learned A.P.P. for the State.

The petitioner, Bhun Yadav is in custody since

21.4.2010 in connection with Anti P.S. Case No. 6 of

2010 under Section 341, 342, 304, 307/34 of the Indian

Penal Code.

According to F.I.R., one miscreant was fleeing

away with a box taking from the house of Fekan Mistri.

The said miscreant was apprehended by the public and

after assaulting him brutally, the public handed over him

to the police. The said miscreant was sent to hospital for

treatment but he died.

The learned counsel for the petitioner

submitted that the petitioner is not named and the

allegation is that mob of 50-60 persons apprehended the

miscreant and assaulted and thereafter handed over him

to the police. In similarly situated case, co-accused

persons have already been granted bail by this Court.

Learned A.P.P. objected the prayer for bail.

It appears that in similarly situated case, the

co-accused persons namely Raj Kishore Sah, Laldeo

Yadav, Ramashish Yadav and Birendra Sharma have been

granted bail in Cr. Misc. Nos. 31660 of 2010, 31572 of
2

2010, 24748 of 2010 and 24230 of 2010 respectively.

Considering the above facts and circumstances,

the petitioner named above is directed to be released on

bail in the above case on furnishing bail bond of Rs.

10,000(Rs. Ten Thousand) with two sureties of the like

amount each to the satisfaction of the Court of learned

Chief Judicial Magistrate, Gaya in Anti P.S. Case No. 6 of

2010.
