Heard learned counsel for the petitioner.

Perused the application.

On the face of the language of Order 17 C.P.C. the

alleged absence of the counsel on the ground of being busy

in other court hardly constitute any sufficient cause for

absence. Learned counsel could have very much made

arrangement when the case was called. The matter was

dismissed when nobody appeared even in second round.

Thus, no case for restoration is made out. The

restoration application is dismissed.
