                          JUDGMENT

Heard Sri. B.Gopakumar, the learned counsel appearing for

the petitioner and Sri. M.A.Asif, the learned Government Pleader

appearing for the respondents.

2. I have by order passed today in W.P.(C).No.29267 of

2009, directed the official respondents to ensure that the

petitioner herein conducts quarrying operations only in

accordance with the permits/licences issued by the competent

authorities. The pleadings discloses that the petitioner has

applied for renewal of the licence issued by the Geologist, well

before the permit expired. Since this Court has not restrained

the petitioner herein from conducting quarrying operations, but

has only directed that quarrying operations should be conducted

in accordance with the terms and conditions of the

permit/licence, I find no reason why the petitioner’s application

for renewal of Ext.P1 permit should not be considered and

disposed of by the second respondent.

I accordingly dispose of this writ petition with a direction to

the second respondent to consider Ext.P2 and take a decision

thereon in accordance with law, within 10 days from the date on

which the petitioner produces a certified copy of this judgment

before the second respondent.
