3 25-10-2011 Heard learned counsels for the petitioner and the State.

The petitioner is apprehending his arrest in a case registered

under Section 304 of the Indian Penal Code.

It is alleged that the petitioner was irrigating the agricultural

land with the help of the naked electric wire which touched the

leg of the victim who subsequently, died due to electric shock.

It is submitted by learned counsel for the petitioner that he

is a bona fide consumer and the Electric Department has not

found any illegality/irregularity in the electric connection and at

best the case under Section 304A I.P.C is made out against the

petitioner.

Considering the nature of accusation, let the above

named petitioner be released on anticipatory bail in the event of

his arrest or surrender before the learned court below within a

period of twelve weeks from today, on furnishing the bail bond

of Rs. 10,000/- (ten thousand) with two sureties of the like

amount each to the satisfaction of learned Chief Judicial
Magistrate, Bhagalpur in connection with Kajraili P.S. Case No.

32/2011 subject to the conditions as laid down under Section

438(2) of the Cr.P.C.
