                       JUDGMENT

Petitioner states that he was granted leave

without allowance based on his application, for the period

from 1.10.2001 to 30.3.2002 subject to the condition

that the period will not be reckoned for service benefits

including increments. According to the petitioner the said

clause is in conflict with the rules contained in the KSR

and the judgment of this court reported in 2007(1) KLT

71.

2. Highlighting these grievance and seeking the

deletion of the condition referred to above, Petitioner

states that he has filed Exts.P1 and P2 before the first

respondent and the complaint now raised is that orders

have not been passed on the representations so made.

3. If as stated by the petitioner, he has filed

Exts.P1 and P2 objecting to the conditions incorporated in

the order granting leave without allowance, the

respondent shall consider the same.

Therefore, I dispose of this writ petition directing

that the respondent shall consider and pass orders on

Exts.P1 and P2. This shall be done as expeditiously as

possible and at any rate within 3 months from the

date of production of a copy of the judgment and with

notice to the Petitioner.
