Petitioner to take steps within one week. All the respondents may file counter
affidavit by the next date fixed.

On behalf of the petitioner it is contended that she was transferred and she
joined at the transferred institution as early as on 06th September, 2007. The
U.P. Secondary Education Services Selection Board was informed by the
institution of the said transfer of the petitioner qua the post of L.T. Grade
Teacher (Home Science). Despite the same, the U.P. Secondary Education
Services Selection Board advertised the vacancy vide Advertisement No. 1 of
2009 and has now recommended a select panel for the post.
Counsel for the petitioner submits that in the facts of the case the vacancy
stood exhausted with the appointment of the petitioner by way of transfer,
which was effected much prior to the date of advertisement.
The matter does require enquiry by this Court.
Till the next date of listing no further action shall be taken in pursuance to the
select panel qua the institution, namely R.D. Inter College, Sikka Silawar,
District Muzaffarnagar.
