                              J U D G M E N T

The State Government set up a Mini Industrial Estate

in Athani in Thrissur District. Some sheds are set apart for

members of Scheduled Caste communities. Petitioner was

allotted one such shed. However, he did not execute the

agreement and take over possession of the shed. He

submits that he was in grave difficulties; his wife suffered

paralytic stroke and his residential building had collapsed.

In its nut shell, the plea of the petitioner is for an

opportunity to have his lapses and laches condoned, so that

he could take possession of the shed that was originally

allotted to him.

The State Government is the competent authority to

deal with such matters. The General Manager of the DIC

has necessarily to act as directed by the Director of

Industries, who has sufficient powers to answer the request

of the petitioner. The Director of Industries would look into

any representation of the petitioner for sympathetic

consideration of his case and issue appropriate orders in

accordance with law. Let the petitioner be given an

opportunity of hearing in the matter. Let the matter be

considered expeditiously, at any rate within a period of 4

months from the date of receipt of a copy of this judgment

and representation as may be made by the petitioner to the

Director of Industries. Interim order granted will stand

extended till orders are passed as aforesaid on condition

that the petitioner makes his representation within a

fortnight of issuance a certified copy of this judgment. The

writ petition is ordered accordingly.
