2. In our order dated 29 October, we had directed (a) that a certain specific 

number of  information should be provided  to the Appellant and (b) that  the 

Branch Manager should appear before us to explain why he had not responded 

to the RTI­application at all.   Today, during the hearing, the Branch Manager 

concerned was present before us and submitted that around the time the RTI­

application was filed (23 May 2009), he was on leave due to the illness of his 

son who had been admitted in Nimhans at Bangalore.  He submitted that in his 

absence, the RTI­application had been received by the Assistant Manager, Shri 

CIC/SM/A/2009/001886
Prabhat Kumar, who had probably misplaced the application and never brought 

it up either before him or had transferred it to the designated CPIO.  He further 

informed that the said Shri Prabhat Kumar had since retired from the service 

w.e.f. 31 May 2010.  We verified the records produced by the Branch Manager 

concerned and found that he was indeed on leave during this period.  

3. We   also   perused   the   records   produced   by   him   and   noted   that   the 

desired information has since been sent to the Appellant/Complainant.

4. In   view   of   the   fact   that   the   person   concerned   responsible   for   not 

attending to the RTI­application in time is no more in service of the Bank, it 

would not be possible for the Commission to penalise any particular individual 

for the delay in this case.  

5. The case is disposed of accordingly.  

6. Copies of this order be given free of cost to the parties.
