Petition for bail.

2. The alleged offences are under Sections 451, 392 and

302 read with Section 34 of the Indian Penal Code. According to

prosecution, on 21.03.2010 at about 11.30 A.M., petitioner

along with other accused entered the house of one Thankamma

and the second accused committed theft of Rs. 3,000/- and gold

ornaments worn by her. First accused inflicted a blow on the

head of victim and tied her legs and threw her into the well

situated in front of the house and she died.

3. This is the second application for bail. Petitioner was

arrested on 28.03.2010 and he is in custody for the past 71

days.

4. This petition is not opposed. Learned Public Prosecutor

submitted that he has no objection in granting bail but

conditions may be imposed.

5. On hearing both sides, I am satisfied that bail can be

granted on conditions. Hence the following order is passed:

Petitioner shall be released on bail on his

executing a bond for Rs.50,000/- with two

solvent sureties each for the like sum to the

satisfaction of the Magistrate Court concerned on

the following conditions:

i) Petitioner shall report before the
Investigating Officer on every Monday
and Thursday, between 10 A.M. and 1
P.M., until further orders.

ii) Petitioner shall not enter the limits of the
police station within a period of two
months, within which the crime is
registered, except for compliance of
condition no.1, until further orders.

iii) Petitioner shall not influence or intimidate
any witness or tamper with the evidence.

This petition is allowed.
