The petition for condonation of delay of 197 days in filing the
proposed appeal has been preferred by the petitioner. From the
record it appears that the counsel appearing on behalf of the
appellant in the original writ petition was elevated as a High Court
Judge, and later on applicant could come to know of the order from
the Registry of the High Court. It is stated that the applicant
tried to find out whether any notice was received from the Registry,
but no such notice could be traced out and therefore, appeal could
not be preferred within the time. Notices were served on the
respondents. No affidavit has been filed opposing the prayer.

Having
heard counsel for the parties and on being satisfied with the
grounds, we condone the delay of 197 days in preferring the appeal.
Civil Application No.8117 of 2010 stands disposed of.
