1. Having
heard Shri Dhaval Barot, learned advocate appearing on behalf of the
applicants, Shri Nirav Trivedi, learned advocate appearing for Shri
Sanjanwala, learned advocate appearing on behalf of opponent no. 1
and Shri Harsheel Shukla, learned advocate appearing for H.L. Patel
Advocates for opponent no. 2 and as the present application is to
restore Miscellaneous Civil Application No. 739/2001, which was to
restore Special Civil Application No. 6663/1990, which came to be
dismissed for non-prosecution, the present application is allowed and
Miscellaneous Civil Application No. 739/2001 is hereby ordered to be
restored to file.
2. With
this, the present application is allowed. Rule is made absolute
accordingly. No cost.
3. Registry
is directed to notify Miscellaneous Civil Application No. 739/2001
for further admission hearing on 23/02/2011.
