                                 ORDER

This petition is for bail.

2. The alleged offences are under Section 399 IPC.

According to prosecution, petitioner along with seven others were

found sitting in a Scorpio car in front of a bank at about 2:30 A.M.

Chilly powder, iron rods, sword, chopper, mask etc. were seized

from the car. Petitioner was arrested from the spot.

3. Petitioner is in custody for the past 23 days. Learned

counsel for the Petitioner submitted that petitioner is working in

Army. He is working in 17th Artillery of Paramilitary. He had gone

to attend a marriage function along with few other relatives at

about 9:30 A.M on 17/05/2010. But, it so happened that some of

the persons sitting in the car were involved in other crimes ran

away when the highway police intercepted. Petitioner was

arrested. Petitioner is innocent of the allegations made.

4. learned Public Prosecutor pointed out that first accused

is involved in one more crime. Sixth accused is involved in three

other cases including offence under Section 326 IPC. Against

seventh accused also there are four other crimes including

offences under Sections 307 and 395 IPC. Against eighth accused

also there is another crime. However, it is submitted that

petitioner is not involved in any other crime hence he has no

objection in granting bail on conditions.

5. On hearing both sides, I am satisfied that bail can be

granted to petitioner on conditions. Hence, the following order is

passed:

Petitioner shall be released on bail on executing a

bond for Rs.50,000/- (Rupees fifty thousand only) each

with two solvent sureties each for the like sum to the

satisfaction of the court concerned, on the following

conditions:

(i) Petitioner shall report before the Investigating

Officer as and when required and co-operate

with investigation .

(ii) In case the petitioner is involved in any similar

case, his bail is liable to be cancelled.

Petition is allowed.
