2 03.02.2011 All the above-said Cr. Misc. Cases are taken enbloc

as the said Cr. Misc. Cases arise out of the same case i.e.

Didarganj P.S. case No. 92 of 2010 registered under sections-

395, 397 & 412 of the Indian Penal Code and accordingly, the

aforesaid Cr. Misc. Cases are being disposed of by this

common order.

Heard learned counsels appearing in the above said

Cr. Misc. Cases for the petitioners as well as learned counsel

for the state.

Petitioners are not named in the F.I.R. nor they have

been put on T.I.P. Admittedly, nothing has been recovered from

possession of the petitioner in Cr. Misc. No. 178 of 2011 but the

aforesaid petitioner carries criminal antecedent of one case in

which he has already been released on bail.

So far as rest petitioners are concerned, it is stated

that some cash has been recovered from their possession but

there is nothing in the impugned order to show this fact that the

recovered cash belonged to the alleged occurrence. Although

some of the petitioners carry criminal antecedent, but

considering this aspect of the matter that except the

confessional statement of co-accused and alleged recovery of

petty amount, there is nothing against them, I think it proper to

release the above-said petitioners on bail.

Accordingly, the petitioners, namely, Rupesh Kumar

@ Rupesh Sahni (in Cr.Misc. No.178 of 2011), Brajesh Singh

(in Cr.Misc. No.1483 of 2011), Neri Gope @ Biru Gope (in

Cr.Misc. No.3272 of 2011) and Sudhir Kumar (in Cr.Misc.

No.4026 of 2011) are directed to be released on bail on

furnishing bail bond of Rs 10,000/- (ten thousand) each with two

sureties of the like amount each in connection with Didarganj

P.S. case No. 92 of 2010 to the satisfaction of Additional Chief

Judicial Magistrate/concerned court, Patna City.
