Civil
Application No.3767/1991 is filed for condonation of delay, which is
pending since long. This Court has issued rule in the year 1993,
however, it could not be served on the other side. Lastly, when this
matter was placed before the Court on 18.02.2009, fresh rule was
issued making it returnable today.
The
applicant-Corporation has filed affidavit and stated that they are
not in a position to serve the respondent and, hence, this
application may accordingly be disposed of.
In
view of the above, Civil Application No.3767/1991 stands disposed of
accordingly. Rule is discharged.
In
view of the above order, First Appeal No.1807/1997 and Civil
Application No.3768/1991 also stand disposed of as they do not
survive.
