ORDER
Background
1. The Applicant filed his RTIapplication with the CPIO on 16.06.2008 with 11 items of queries on
matters related to his deputation in the Mahatma Gandhi Antrarashtriya Hindi Vishwavidyalaya, The
CPIO replied to these queries on 16.07.2008. The Applicant, not satisfied with the reply, filed a
complaint in the Commission. The Commission by its order in F.No. CIC/OK/C/2008/00797/SG dated
12.012.2008 disposed of the said complaint with the direction that the Appellate Authority should
decide the matter after giving a hearing to both parties.
2. The Appellant Authority, in compliance with the Commission’s decision, gave a hearing to the
Applicant on 03.02.2009 and recorded that he had discussed the issue related the information
sought and has provided the available records to Applicant . For the balance information, the AA
stated that he had given direction to the CPIO to furnish the same to the Appellant.
3. The Appellant, thereafter, filed the present appeal in the Commission on 28.05.2010 stating that he
CPIO had given incomplete, misleading, and incorrect information to him.
Decision
4. During the hearing, the Respondent stated that they had 3 main files connected with the matter
related to the Appellant’s RTIqueries which had already been shown to the Appellant.
5. The Appellant stated that the Respondents had inflicted harassment on him by asking him to come to
their place for hearing and not giving the required information, even after he had gone for the hearing
. He suspected that the Respondents are not coming out with complete details/information which they
are having on their files.
6. The Respondents at this stage assured the Commission that they would try and locate any additional
files lying with other Sections, pertaining to the Appellant and connected with the Appellant’s case
and requested for at least one month to complete this exercise.
7. After considering all aspects of the matter and upon hearing the submissions of the parties, the
Commission directs the Respondents to revisit their records and check whether any other
documents/papers related to Appellant’s case mentioned in his RTIapplication are available with
them. In the event, they are able to locate any such records, they should allow inspection of these
records by the Appellant straightaway and provide him with copies of documents required by him. In
the event no new records/files are available they should file an affidavit before the Commission with
a copy to Appellant stating that they do not have any further information except that already
provided to Appellant. This affidavit may reach the Commission by 10 March, 2011.
8. The Appellant also brought to the Commission’s notice that the Commission in its decisions in appeal
Nos. CIC/WB/A/2010/000560AD, CIC/WB/A/2010/000562AD & CIC/WB/C/2010/000414AD all
dated 24.12.2010, which also pertained to the present parties, had inadvertently not set the time limit
for compliance with its directions. He, therefore, requested the Commission to do the same.
9. The Commission accepts the Appellant’s submission and accordingly directs the Respondents to
comply with the directions given in the above three cases by 5.3.2011.
10. The appeal disposed of with the above directions.
