petition has been filed for restoration of First Appeal No. 955 of
2007 which was dismissed for non-prosecution in absence of the
counsel on 26.3.2008.

Notices
were issued on the respondents. They have not filed any application
opposing the prayer.

Having
heard the counsel for the petitioner and taking into consideration
the ground shown and being satisfied with the ground, the petition
for restoration is allowed. First Appeal No. 955 of 2007 is restored
to its original file.

This
Misc. Civil Application stands disposed of.
