Raman, J.

After disposal of this writ petition and before the order was signed,

learned counsel for the respondent pleaded that since a counter affidavit is

filed in the matter, his absence may be excused and he may be heard.

Accordingly, the matter was re-posted and we heard the matter.

2. Petitioner seeks for police protection. Petitioners and respondents

4 to 8 are neighbours. There is a dispute pending between the petitioners

and the party respondents. According to the petitioners, because of the said

dispute there is constant threat from the party respondents and a criminal

case against the respondents have been registered. Respondents 4 to 8, in

their counter affidavit stated that as against the second petitioner’s father, a

crime was registered for assault and injury caused on the 6th respondent.

The allegation made in the writ petition are denied by them. According to

them, the threat is from the petitioners.

3. The learned Government Pleader appearing on behalf of the State

submitted that a case is registered against some of the respondents and he is

not aware of any case being registered against the petitioners. But the

counter affidavit producing the FIR shows that a case is registered against

the second petitioner’s father. In such circumstances, it is necessary to

maintain law and order. Since the parties are neighbours and there is a

boundary dispute, police will see that dispute between the parties does not

lead to any law and order situation and protection shall be afforded against

any threat to the petitioners. If there is any such threat against the

respondents, it is open to them to seek similar relief.

The writ petition is disposed of as above.
